These Terms of Service (“Terms”) govern reservations made through Ohana Vacations websites and booking experiences that link to these Terms.

By completing a reservation, including by clicking the button to finalize a booking, you agree to these Terms and to the reservation-specific price, payment conditions, cancellation policy, property rules, and other material conditions disclosed in connection with your reservation.

1. About Ohana Vacations and the Property

“Ohana Vacations,” “we,” “us,” and “our” refer to JBC VACATIONS INC., DBA Ohana Vacations, when acting in connection with the applicable reservation.

JBC Vacations provides vacation-rental booking, management, and hospitality services for properties that may be independently owned.

Depending on the property, JBC Vacations may act as owner, operator, property manager, booking agent, or service provider on behalf of the applicable property owner.

2. Agreement Governing Your Reservation

Your reservation is governed by:

These Terms;

The property, dates, occupancy, rate, taxes, fees, and other details shown during booking;

The cancellation and refund policy applicable to the reservation;

Property-specific terms and rules disclosed in connection with the reservation; and

Reasonable operational and safety requirements applicable to the property.

Reservation-specific terms control over conflicting general provisions of these Terms with respect to that reservation.

3. Guest Eligibility and Responsibility

You must have legal capacity to enter into a binding agreement and satisfy any minimum-age requirement disclosed for the property.

The person making the reservation is the primary guest and is responsible for:

Accurate reservation information;

Required payments;

Compliance with these Terms;

Compliance by all members of the guest’s party and visitors; and

Charges and obligations properly arising from the reservation.

You may not use false information, impersonate another person, or use an unauthorized payment method.

4. Reservation Confirmation

A reservation is confirmed when confirmation is issued by us or the applicable booking platform.

You are responsible for promptly reviewing the confirmation.

Availability, pricing, policies, restrictions, and fees may vary by property, date, booking channel, and rate plan.

5. Rates, Taxes, and Fees

You agree to pay the rates, taxes, fees, and charges disclosed in connection with your reservation.

Charges may include:

Accommodation charges;

Applicable taxes;

Cleaning fees;

Pet fees;

Additional guest fees;

Deposits;

Optional services; and

Other charges disclosed before booking or separately authorized.

Rates and availability may change until confirmation.

Obvious pricing or technical errors may be corrected. If a material error affects a confirmed reservation, reasonable options may include accepting corrected terms or canceling the affected reservation with a refund of amounts paid for accommodations that will not be provided.

6. Payment Authorization

By providing a payment method, you represent that you are authorized to use it.

You authorize Ohana Vacations and applicable payment processors to charge that payment method for:

Amounts due at booking;

Scheduled remaining payments;

Taxes and disclosed fees;

Authorized modifications, extensions, or services; and

Other amounts properly chargeable under these Terms.

Failure to make required payment may result in cancellation subject to applicable reservation terms.

7. Cancellations, Changes, and Refunds

Each reservation is governed by the cancellation and refund policy disclosed for that reservation or rate plan.

Policies may vary by property, booking channel, dates, season, length of stay, or rate.

Unless applicable law or the reservation policy provides otherwise:

Late cancellation may result in partial or complete forfeiture of amounts paid or due;

A no-show may be treated as a cancellation;

Early departure does not automatically create a right to a refund; and

Changes are subject to availability, current rates, and applicable policies.

Third-party booking platforms may impose additional procedures.

8. Property Unavailability

If a reserved property becomes unavailable or materially unsuitable because of significant maintenance failure, damage, safety concerns, government restrictions, or other circumstances, we may, depending on the situation:

Offer alternative accommodations;

Offer different dates;

Provide a mutually agreed credit;

Cancel the affected reservation and refund amounts paid for accommodations we cannot provide; or

Offer another reasonable remedy.

Except where required by law, consequential expenses or losses caused by circumstances outside reasonable control are not our responsibility.

9. Check-In and Checkout

Guests must comply with applicable arrival, access, check-in, and checkout procedures.

You may not enter before authorized check-in without permission and must vacate by checkout unless otherwise authorized.

Unauthorized early arrival or late departure may result in reasonable additional charges where disclosed or legally permitted.

Keys, codes, and access credentials must not be shared with unauthorized persons.

10. Occupancy and Visitors

Occupancy may not exceed the maximum permitted for the property or reservation.

Only permitted guests and visitors may occupy or use the property.

The primary guest is responsible for the conduct of all persons associated with the reservation.

Unauthorized occupancy, parties, events, or visitors may result in charges, termination of the stay, or other lawful remedies.

11. Property Rules and Guest Conduct

Guests must treat the property, neighboring properties, staff, contractors, and community with reasonable care and respect.

Property rules may address:

Smoking or vaping;

Pets;

Noise and quiet hours;

Parties and events;

Parking;

Occupancy;

Pools and hot tubs;

Fireplaces, grills, or fire features;

Trash;

Septic or utility restrictions;

Security;

Furniture and equipment; and

Other safety or operational requirements.

Illegal activity, dangerous conduct, intentional property damage, harassment, threats, excessive disturbance, or serious rule violations are prohibited.

12. Termination of Stay

To the extent permitted by law, a guest may be refused entry or required to leave because of:

Fraud or material misrepresentation;

Failure to pay;

Serious or repeated rule violations;

Unauthorized parties or occupancy;

Illegal or dangerous conduct;

Threats, harassment, or abuse;

Material property damage;

Unreasonable safety risks or disturbances; or

Lawful orders requiring removal.

Refund eligibility depends on the circumstances, applicable law, and reservation terms.

13. Damage, Excessive Cleaning, and Additional Charges

Guests are responsible for damage, loss, or extraordinary cleaning costs caused by the primary guest, members of the guest’s party, visitors, or animals associated with the reservation, beyond ordinary wear and tear.

Where permitted by law and supported by the circumstances, reasonable charges may apply for:

Property damage;

Missing or destroyed property;

Excessive cleaning;

Unauthorized smoking;

Unauthorized pets;

Unauthorized occupancy, parties, or events;

Lost keys or access devices;

Fines or charges resulting directly from guest violations; or

Other reasonably documented losses for which the guest is responsible.

Claims may be supported by photographs, video, invoices, inspection records, communications, or other reasonably available evidence.

14. Maintenance and Amenities

Temporary interruptions or failures involving utilities, internet, appliances, pools, hot tubs, climate systems, or other amenities may occur.

Guests should promptly report significant problems and provide a reasonable opportunity to investigate and correct them.

A temporary amenity failure does not automatically entitle a guest to a full refund.

Any remedy depends on the severity, duration, effect on the stay, ability to correct the issue, reservation terms, and applicable law.

15. Safety

Vacation rentals may contain or be near stairs, balconies, bodies of water, pools, hot tubs, fireplaces, wildlife, natural terrain, weather hazards, roads, or other features involving ordinary travel risks.

Guests are responsible for reasonable care and appropriate supervision.

Nothing in these Terms waives liability that cannot legally be waived.

16. Personal Property

Guests are responsible for safeguarding personal belongings.

To the fullest extent permitted by law, Ohana Vacations and applicable property owners are not responsible for loss, theft, or damage to personal property except where liability cannot legally be excluded.

17. Events Beyond Reasonable Control

Neither Ohana Vacations nor applicable property owners are responsible for failure or delay caused by events beyond reasonable control, including severe weather, wildfire, flood, natural disaster, government action, widespread outages, public emergencies, or similar events.

Available remedies depend on applicable reservation terms and law.

Travel insurance is encouraged where appropriate.

18. Communications

Reservation confirmations, receipts, policies, notices, disclosures, and transaction-related communications may be provided electronically.

You are responsible for maintaining accurate contact information.

19. Website Use and Intellectual Property

Websites may be used only for lawful personal and travel-related purposes.

Unauthorized access, interference, fraud, impersonation, malicious code, fraudulent reservations, or misuse of reservation or payment systems is prohibited.

Website content is owned or licensed by the applicable rights holders and protected by law.

20. Listing Information

Reasonable efforts are made to provide accurate descriptions, photographs, availability, and pricing.

Minor differences may arise from updates, replacement furnishings, maintenance, seasonal conditions, or photography.

Material changes affecting a confirmed reservation will be addressed in accordance with these Terms and applicable law.

21. Limitation of Liability

Nothing in these Terms limits rights or liabilities that cannot legally be limited.

To the fullest extent permitted by law, Ohana Vacations, applicable property owners, and their representatives will not be liable for indirect, incidental, special, or consequential losses arising from circumstances outside reasonable control, guest negligence or conduct, violations of these Terms, or misuse of a property.

These Terms do not limit liability for fraud, willful misconduct, or liability that applicable law prohibits from being waived.

22. Privacy

Our handling of personal information is described in our Privacy Policy.

23. Changes to These Terms

We may update these Terms prospectively.

The Terms applicable to a reservation generally will be the version presented or made available in connection with that reservation together with applicable reservation-specific policies.

24. Severability and No Waiver

If a provision is unenforceable, it will be enforced to the maximum lawful extent or severed, and the remaining Terms will remain effective.

Failure to enforce a provision does not waive future enforcement.

25. Applicable Law

These Terms and reservations are subject to applicable federal, state, local, and, where applicable, foreign law.

Applicable law may depend on the location of the property and other legally relevant circumstances.

Nothing in these Terms deprives consumers of mandatory legal protections.
